Terms of Service

Effective date: June 3, 2026

These Terms of Service (the “Terms”) govern your use of the Cortex SMS notification service (the “Service”) provided through cortexnotify.com. By submitting the opt-in form or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and an authorized account holder on a registered home-automation account to receive Cortex notifications. By signing up, you represent that you meet these requirements and that you own or are authorized to use the mobile number you provide.

2. The Service

Cortex sends transactional SMS notifications related to events on your registered home-automation account, including but not limited to: door and entry state changes, system and sensor status, environmental conditions, and account summaries. Cortex does not send marketing or promotional messages.

3. SMS terms

• Frequency. Message frequency varies based on the events occurring on your account.
• Rates. Message and data rates may apply. Cortex is not responsible for charges imposed by your wireless carrier.
• Carriers. Wireless carriers are not liable for delayed or undelivered messages.
• HELP. Reply HELP to any message for assistance, or email contact@cortexnotify.com.
• STOP. Reply STOP to any message to opt out, or use the opt-out form. After opt-out, you will receive one confirmation SMS and no further messages.

4. Consent

SMS notifications are a fully optional feature of the Service. You may register a Cortex account without providing a mobile number or consenting to SMS. Consent to receive SMS is not a condition of account registration or of any other Cortex service.

If you choose to enable SMS notifications by checking the optional SMS consent checkbox on the registration form, you expressly consent to receive recurring SMS notifications from Cortex at the mobile number you provided, generated and delivered using an automatic dialing system. You may withdraw this consent at any time by replying STOP or using the opt-out form.

5. Accuracy

You agree to provide accurate, current information and to update your information if your mobile number changes. You are responsible for promptly opting out if your number is reassigned.

6. Acceptable use

You agree not to use the Service for unlawful purposes, to provide false information, to opt in on behalf of someone who has not consented, or to interfere with the Service’s operation.

7. No warranty

The Service is provided “as is” without warranties of any kind, express or implied. Cortex does not guarantee uninterrupted delivery of any specific message. Do not rely on Cortex notifications as the sole means of safety, security, or emergency response.

8. Limitation of liability

To the maximum extent permitted by law, Cortex is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

9. Termination

Cortex may suspend or terminate the Service at any time, with or without notice. You may terminate by opting out as described above.

10. Changes

Cortex may update these Terms. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws principles.
